Chautauqua co NY Will Book Vol 8 page 631
Written: 25 Jan 1882
Probated: 11 Jul 1887

In the name of God, Amen:
I, Gardner Phillips of Stockton Chautauqua County NY aged 73 years March
20, 1882, being of sound mind and memory, and considering the uncertainty of
this frail and transitory life, do therefore make, ordain, publish and declare
this to be my last Will and Testament, that is to say:

First, after all my lawful debts are paid and discharged I give and
bequeath the use, control, management and occupancy of my house of eleven
acres on the south side of the Highway to my wife Sally Ann Phillips during
her life, and the use of all my personal property during her life time, and if
the use is not enough for her comfortable support, maintenance and convenience
then to use whatever may be necessary for her comfortable support, maintenance
and convenience during her natural life, and burial expenses and tomb stones,
also tomb stones for myself of good substantial plain style.

After the decease of myself and my wife, and all just expenses and debts
are paid, whatever is left I give and bequeath to be equally divided between
my six daughters Aurilla Ide now wife of George A.(?) Ide, Clarissa Ann
Douglass now wife of Joseph Douglass, Betsey Ames now wife of Emery Ames,
Phoebe E. Briggs now wife of David Briggs, Patty Seeley now wife of George
Seeley, and Huldah M. Mansfield now wife of Curtis Mansfield share and share
alike. If any of my said daughters should die before my death or the death of
my said wife without leaving any descendents then surviving, their said share
shall be equally divided with the shares of the other daughters as aforesaid.

Likewise, I make, constitute and appoint my daughters Clarissa Ann
Douglass and Phoebe E. Briggs to be Executrixes of this my last Will and
Testament, hereby revoking all former Wills by me made.

In Witness Whereof I have hereunto subscribed my name and affixed my seal
the twenty fifth day of January in the year of our Lord one thousand eight
hundred and eighty two.
Gardner
Phillips, L.S.

The above written instrument was subscribed by the said Gardner Phillips
in our presence, and acknowledged by him to each of us, and he at the same
time declared the above instrument, so subscribed, to be his last Will and
Testament, and we, at his request, have signed our names as witness hereto, in
his presence and in the presence of each other and written opposite our names
our respective places of residence.
